信息服务风险规避视角下的大数据控制人财产权利与限制研究

Study on Property Rights and Restrictions of Big Data Controllers Based on Information Service Risk Aversion

摘要:

文章在界定大数据控制人的定义、类型、资格及其与数据原权利人关系基础上,对大数据控制人享有的财产权利及行使权利过程中应受到的合理限制进行探讨。研究认为:大数据控制人是对其合法获取并实际控制的数据享有完整或部分财产权利并承担相应法律义务的组织和个人,分为组织型和个人型两类,组织和个人要想成为大数据控制人必须具备五个基本条件:大数据控制人和数据原权利人间是授权与约束关系;大数据是数据控制人的数据资产,控制人对其享有全部或部分财产权利;大数据控制人的财产权利来自法律赋权和数据原权利人的许可授权;控制人对数据财产权利的正确行使是实现大数据价值和降低信息服务风险的前提和保证;大数据控制人在行使财产权过程中应受到必要限制,不得损害国家安全、公共利益、商业秘密和个人隐私。

Abstract:

This paper defines the concept, the type and qualifications of big data controller, discusses the property rights of the big data controller and the reasonable limit of the exercise of the rights. The study believes that big data controller is organizations and individuals who have legitimate access to and control of the actual data to enjoy complete or part of the property rights and assume the corresponding legal obligations, and big data controller includes two types of organizations and individuals. To become the legal sense of the big data controller, the organizations and individuals needs to have five basic conditions: big data controller and original obligee of the data have authorized and binding relationship;big data is the data controller’s data assets,controller enjoy all or part of property rights; big data controller’s property rights come from the legal provisions and data of the original owner of the license authorization; data property rights of controller exercise correctly is the premise and guarantee to realize the value of big data and reduce the risk of information services; data controller in the exercise of property rights should be subject to necessary restrictions, and shall not damage national security, public social interest, business secrets and personal privacy.
