Research on the Problems and Solutions of Digital Publishing Laws and Regulations Based on Google Books Library Project

Abstract:

A new form of digital publishing spreads at a global scale represented by Google Library Project, but due to adopting the way of “after the first use license” scanning cooperation and establishing the database of library books, the plan was sued and rejected by varying degrees in multiple countries including USA, France, China, etc.based on the fair use and protection of orphan works. It fully reflects the contradictions and conflicts in the different definitions of fair use, the protection of orphan works and cultural protection in the national digital publishing laws and regulations. To solve these problems, countries should strengthen international cooperation and coordination, improve relevant laws and regulations of digital publishing, oppose cultural monopoly and protect cultural safety.
