Abstract:
In addition to facing tremendous diplomatic pressures, This paper analyzes the international environments, i.e. foreign countries have strengthened increasingly enactments and revisions of their laws on online information regulatory activities, issued many policies on them, which are faced by the Chinese laws and policies on the online information regulation. It indicates urgent demands from the domestic online industries for improving the related Chinese laws and policies by sorting out such statuses as scale expansion of domestic online industries, ambiguity in ISP’s regulative liabilities, nonstandard enforcement measures, and by elaborating such flaws in laws and policies as low legal level of norms, conflicts between the regulated information categories in laws, overemphasis on regulation rather than protection of online participants’ rights, states’ regulations contraventions with higher level laws, multiagency regulative system, regulative agencies’ pursuit of their own sectional interests, and the intermittent enforcement activities. It emphasizes the urgency and necessity of comprehensively checking up and improving the related Chinese laws and policies.
