Abstract:

Information technology gives information the economic and social values,and bring huge threat to the security of personal information.In order to protect personal information from abuse by illegal collection or disclosure,right of consent is the principle of all personal information protection law. With the development of data technology, the principle in practice does not achieve the goals be designed, the implementation costs is so high that it becomes the barricades of information flow freely.That’s consent dilemma.This paper analyses the intension and rationales of consent,and foreign practice,and explores the dilemma and solution of the application of consent.Consent is a necessary right of personal autonomy, maintaining the dignity of the human person.There is the theoretical and practical basis.The consent principle without achieving ideal goal doesn't mean it's not important, nor to deny the necessity and legitimacy. Solution to the dilemma of consent principle is to definite the scope and form,and professional Government departments need to regulate the entire process of personal information handling.
