A Research on the Rights and Interests Issues of Research Data Reuse

Abstract:

Based on pragmatic methodology and by using Literature review method, this paper studies the management and distribution of data rights and interests in research data reuse. Information analysis and the method reasonable competing are used to obtain the elements of policies.  The findings demonstrate that the reuse of research data involve different stakeholders, including scientific research funding institutions, scientific research institutions, researchers, libraries and data centers. Researches on the rights of research data reuse should focus on the stakeholders’ core rights and the using conditions of each right. The core rights of stakeholders include reproduction rights, distribution rights, public exchange rights, adaptation rights, excerpts and reuse rights, and the use conditions of each right. Besides, researchers should clarify the rights transfer when research data are be reused. It also should be authorized when reuse research data. The stakeholders can provide five general licensing channels for users. At last, this paper take Taekjip Ha, a scholar of the University of Illinois funded by the National Natural Science Foundation of China, as an example, to analyze the data policies from the perspective of stakeholders.  Based on the results, this paper indicates that exploring a suitable policy implementation about the mechanism of exchanging and distributing the data rights is necessary in China.
