图书馆公众参与的立法保障——以《图书馆法》(征求意见稿)第19条为基础的讨论

摘要:

公众参与对图书馆管理、建设与服务具有重要的价值。《中华人民共和国公共图书馆法》(征求意见稿)第19条确认了图书馆公众参与的权利,但该规定过于简单,对于图书馆公众参与中的诸多基本问题尚未涉及。图书馆公众参与立法保障十分必要,这既是法治的必然选择,也是图书馆法人治理结构的需要与地方立法不足的现实要求。图书馆公众参与立法需要秉持决而不拖、慢而不快、细而不粗的原则。公众参与图书馆应在吸收软法精华的基础上制定统一的国家法,应当采取中央立法与专章立法的形式制定。图书馆公众参与立法应当采用广泛性、大众化与利益回避的标准界定公众参与的主体,规定非参与的参与、象征性参与和决策参与三个不同层次的参与方式,全面涵盖图书馆管理、建设、服务与监督的参与内容。

Abstract:

Public participation plays an important part in library management, construction and service. The nineteenth article of the draft on public library law confirms the right to participate. But the nineteenth article is so simple that there are so many basic issues have been omitted. The necessity of legislation of the library public participation is obviously. The legislation of the library public participation is the inevitable choice of the rule of law, the demand of corporate governance of library and the inadequacies of local legislation of library. The principles of legislation of the library public participation include decision, no hurry and no rough. The legislation of the library public participation should absorb the essence of the soft law of library law and take the form of central legislation and special legislation. The legislation of the library public participation should define the subject of public participation by the standards of universality, popularization and the avoidance of interest and set the way of participation. The legislation of the library public participation should coverage the contents of the public participation, including the library management, construction services and supervision.
